Vancouver, June 7, 2018 – Former Vancouver lawyer Daniel Kar-Yan Kwong has admitted to professional misconduct while representing six clients in immigration-related matters. The Law Society has accepted Kwong’s admissions on the condition that he does not practise law or be a member of the Law Society of British Columbia or elsewhere within Canada prior to April 6, 2020.

In an agreed statement of facts, Kwong admitted to misrepresenting to clients the status of their applications and making statements that he knew or ought to have known were false, failing to provide his clients with the appropriate quality of service expected of a competent lawyer, and improperly withdrawing client trust funds to pay fees or disbursements when he was not entitled to the funds.

Kwong has ceased practising law since February 27, 2017, when he resigned membership in the Law Society. Should he apply for reinstatement after April 6, 2020, Kwong would have to satisfy a credentials hearing panel that he is of good character, fit to practise law, and that he would comply with any conditions or limitations on his practice that may be imposed.
