Vancouver, June 8, 2020 - In the face of discipline proceedings, former Nanaimo lawyer David Allen Kidd has admitted to professional misconduct and undertaken not to apply for reinstatement to the Law Society prior to May 30, 2025.

Kidd was working as deputy regional crown counsel in Nanaimo when he met with a family member of a homicide victim to discuss the trial. The family member presented a handwritten document by the victim regarding her relationship with her boyfriend, who was charged with first-degree murder for her death.

Kidd admitted he committed professional misconduct when he failed to take reasonable steps in relation to the written document the family member brought forward, including his failures to understand the nature of the document, inform other prosecutors on the file of the document, preserve the document and disclose the document to the accused. He also admitted that he failed to keep records of his knowledge and dealings with the written document.

The Discipline Committee accepted Kidd’s admission of professional misconduct and undertaking not to practise law in BC or apply for reinstatement to the Law Society for five years commencing May 29, 2020. Should Kidd wish to apply for reinstatement to the Law Society when his undertaking expires on May 30, 2025, he will have to satisfy the Law Society’s Credentials Committee that he is of sufficiently good character and repute to practise law in BC.
