Lawyer David Y. Chen has admitted to professional misconduct and agreed to serve a two-week suspension that will begin on July 1, 2022. Chen will also meet with a Law Society Bencher to review his conduct and discuss how to avoid issues in the future.

Chen admitted to making a false or misleading representation to opposing counsel, drafting and commissioning an affidavit containing false or misleading representations, and accepting $8,000 in cash for a retainer and refunding a portion of the funds by cheque, contrary to Law Society rules.

In accepting the consent agreement, the Law Society’s Discipline Committee Chair considered that Chen did not have a prior professional conduct record, he was a junior lawyer at the time, and he admitted his misconduct and cooperated with the Law Society’s investigative processes.
