Terrace lawyer Timothy D. Klaassen has received a four-week suspension and is ordered to pay $1,000 in costs after committing professional misconduct by failing to act with courtesy and civility toward opposing counsel during court proceedings.

Klaassen admitted that in 2018 he repeatedly, and inappropriately, alleged that opposing counsel fabricated evidence. He admitted this was contrary to a lawyer’s duty to be courteous and civil, and amounted to professional misconduct.

The hearing panel accepted Klaassen’s admission of misconduct and found he repeatedly made allegations, with no reasonable basis, that challenged opposing counsel’s integrity, and maintained the allegations when the judge repeatedly questioned their basis.

In determining the disciplinary action, the panel considered the impact of Klaassen’s actions, and his previous professional conduct record that indicated similar misconduct. The panel found his early and continued acknowledgement of his misconduct and his apology to opposing counsel to be mitigating factors. 

Klaasen’s suspension will begin on September 11, 2023.
