Vancouver lawyer Gary (Kin Ip) Lo has been suspended for six weeks, starting October 2, 2023, for committing professional misconduct.

Lo admitted that in the course of representing a client in a real estate matter, he failed to disclose to the vendors and to the court that he did not hold all the deposits in trust. He admitted that he acted in a conflict of interest when he represented a company in a private lending transaction, when he was acting or previously acted for the borrower. In addition, he admitted he failed to collect the required client identification and verification information on four occasions.

In considering the consent agreement proposal, the Law Society took into consideration an agreed statement of facts and Lo’s prior professional conduct record, which included an administrative suspension, conditions placed on his practice, a practice supervision agreement and trust supervision agreement with the Law Society, and professional misconduct related to breaching an undertaking.

A summary of the consent agreement can be found here.
