In this course, we thoroughly cover the requirements that must be met for an express private trust to be valid.
We discuss in detail the four requirements:
1) capacity of the parties;
2) the three certainties;
3) trust must be constituted;
4) all requisite formalities must be met.
We break down how each of these requirements may be met, and what will occur if one or several of them are not met.
We end by discussing the limitations on the creation of trusts: what factors may cause them to be invalid.
