Description
This course explores the unnatural ending or altering of a trust: how a settlor may initiate termination, and how beneficiaries can prematurely end the trust. We begin by examining revocation by the settlor, and possible exceptions to the rule against revocation, with a thorough discussion on the rule in Saunders v Vautier. We then explore alteration or amendment of the trust, both through the trust instrument and in common law. We finish with a discussion of variation in trusts, and the two models that exist in Canadian legislation.
