Description
In this course, we thoroughly discuss the three core elements of the tort of negligence: the negligent act, causation, and damage.
We first define the standard of care, which considers a reasonably careful person, and explain how this standard is applied in different circumstances.
We then discuss how causation is established, with attention paid to situations where more than one person engaged in negligence.
The last element of negligence, damage, is discussed with reference to the duty of care, reasonable foreseeability, and special remoteness issues.
Lastly, we guide you through defences and remedies for negligence.
