Nature of conduct to be inquired into:

  1. On or about February 15, 2011, in your capacity as principal and director for C Mortgage Corporation, you caused C Mortgage Corporation to enter into a loan agreement as lender, which loan agreement you knew or ought to have known provided for interest at a criminal rate, as defined in section 347 of the Criminal Code of Canada, contrary to Chapter 2, Rule 1 of the Professional Conduct Handbook, then in force.

This conduct constitutes professional misconduct or conduct unbecoming a lawyer, pursuant to s. 38(4) of the Legal Profession Act.

  1. In or about April 2014, in the course of testifying in an action commenced by C Mortgage Corporation in the Vancouver Registry of the Supreme Court of British Columbia, Docket [number], you gave misleading evidence to the Court with respect to the rate of interest to be charged in a loan agreement dated for reference February 15, 2011.

This conduct constitutes professional misconduct or conduct unbecoming a lawyer, pursuant to s. 38(4) of the Legal Profession Act.
