Complaints, Lawyer Discipline and Public Hearings

Citations are authorized by the Law Society of BC's Discipline Committee and list allegations against a lawyer that will be considered at a discipline hearing. Please note that allegations in a citation are unproven until a discipline hearing panel has determined their validity.

Nature of conduct to be inquired into:

1.  You accepted one or more gifts that were more than nominal from your client JB when your client had not received independent legal advice, contrary to rule 3.4-39 of the Code of Professional Conduct for British Columbia. In particular:

(a)  in or about July 2014, you accepted a monetary gift of $75,000 from JB; and

(b)  in or about December 2015, you accepted a monetary gift of $25,000 from JB.

This conduct constitutes professional misconduct, pursuant to section 38(4) of the Legal Profession Act.

2.  In or about January 2014, you caused to be prepared for your client JB a will that gave you a testamentary gift from the client, contrary to one or more of rules 3.4-26.1 and 3.4-38 of the Code of Professional Conduct for British Columbia.

This conduct constitutes professional misconduct, pursuant to section 38(4) of the Legal Profession Act.
