Complaints, Lawyer Discipline and Public Hearings

Citations are authorized by the Law Society of BC's Discipline Committee and list allegations against a lawyer that will be considered at a discipline hearing. Please note that allegations in a citation are unproven until a discipline hearing panel has determined their validity.

Nature of conduct to be inquired into:

1.  Between approximately May 11, 2017 and July 23, 2017, in the course of representing your client TO, you did one or more of the following:

(a)  misappropriated some or all of $1,000 provided by the client to you as a retainer;

(b)  failed to deposit the retainer funds into a pooled trust account, contrary to Rule 3-58 of the Law Society Rules;

(c)  deposited the retainer funds into your personal bank account prior to rendering a bill for legal services, contrary to one or more of rule 3.6-10 of the Code of Professional Conduct for British Columbia and s. 69 of the Legal Profession Act; and

(d)  failed to record all funds received and disbursed by maintaining the required records, contrary to Rule 3-67(2) of the Law Society Rules.

This conduct constitutes professional misconduct, or a breach of the Act or rules pursuant to s. 38(4) of the Legal Profession Act.

2.  Between approximately November 2016 and July 2017, in the course of representing your client PP, you did one or more of the following:

(a)  misappropriated some or all of $5,825 provided to you for payments of retainers and/or disbursements;

(b)  failed to deposit the retainer and/or disbursement funds into a pooled trust account, contrary to Rule 3-58 of the Law Society Rules;

(c)  deposited the retainer and/or disbursement funds into your personal bank account prior to rendering a bill for legal services, contrary to one or more of rule 3.6-10 of the Code of Professional Conduct for British Columbia and s. 69 of the Legal Profession Act; and

(d)  failed to account for the receipt of the retainer and/or disbursement funds, contrary to one or more of Rule 3-54 of the Law Society Rules and rule 3.5?6 of the Code of Professional Conduct for British Columbia.

This conduct constitutes professional misconduct, or a breach of the Act or rules pursuant to s. 38(4) of the Legal Profession Act.
