Summary of Decision on Application for Adjournment

PIR INDAR PAUL SINGH SAHOTA

Written submissions: February 1 and February 6, 2018

Decision issued: February 16, 2018 (2018 LSBC 06)

Bencher: Steven McKoen

Counsel: Alison Kirby for the Law Society; Craig Jones, QC for Pir Sahota

BACKGROUND

Pir Sahota sought an adjournment of the hearing scheduled for a citation issued on November 10, 2016. A hearing was scheduled for October 24, 2017 but did not commence because Sahota requested an adjournment. The president of the Law Society directed Sahota to provide alternate dates for a hearing. He did not provide those dates and indicated that he would not be in the country in January 2018. The president ordered the hearing be set for February 15, 2018.

Sahota is also subject of a separate discipline matter which went to a penalty hearing. The decision is now the subject of a s. 47 review, which will be held on February 27, 2018.

On February 1, Sahota made an application to adjourn the hearing and asked it for it be rescheduled, upon the release of the s.47 review decision on the separate discipline matter given the parallels between the two cases.

DECISION

The Bencher found an adjournment is warranted until the decision is rendered in the review matter, as the findings of the hearing panel in the other discipline matter are likely to be relevant to the current case. The application is granted.
