Summary of Decision of the Hearing Panel on an Application to Adjourn

Hong Guo

Richmond, BC

Decision issued: March 9, 2021 (2021 LSBC 09)

Written materials: February 24, 2021

Panel: Jennifer Chow, QC (Chair), Ralston Alexander, QC and John Lane

Counsel: Alison Kirby for the Law Society; Gerald Cuttler, QC for Hong Guo

BACKGROUND

The panel issued its decision on facts and determination (2020 LSBC 52), and the hearing for disciplinary action was scheduled. Shortly after the facts and determination decision was published, the Law Society advised Hong Guo that it would likely seek disbarment for the penalty. Guo’ s counsel requested the Law Society provide its submissions on disciplinary action by a certain date, as he would require at least 30 days to prepare his response. The Law Society responded that its submissions would not be available until later. Guo applied to the panel chair to adjourn the disciplinary action hearing.

DECISION

The panel considered the seriousness of the possible disciplinary action and determined the foundation for the requested adjournment was solid. The panel granted Guo’ s request to adjourn the disciplinary action hearing and directed counsel to exchange submissions and to seek new dates for the hearing promptly.
