In its decision dated November 4, 2016, a panel of Benchers reversed the decision of a hearing panel and dismissed the citation issued against Peter Krogh Jensen (2016 LSBC 37; Winter 2016 discipline digest).

The review panel in general allowed costs to the Respondent where he was successful and made no award where he was not. The Law Society submitted that costs of unsuccessful applications made by the Respondent should be deducted from the overall award to the Respondent. The review panel declined to do so because that would, in essence, award costs to the Law Society in any event of the cause, a remedy usually applied to applications without significant merit.

The review panel allowed costs and disbursements of $31,256.38
