FACTS
On October 4, 2022, an administrative penalty was assessed against Malcolm G. McMicken for $3000. The administrative penalty resulted from a breach of Rule 3-96.1 of the Law Society Rules 2015, which prohibits a lawyer from sharing their Juricert password with another person, or permitting another person to use the password to access the Land Titles Office online system. Specifically, McMicken admitted to sharing their Juricert password with their assistant, and permitting their assistant to affix their signature on Land Title Office documents on their behalf.
McMicken paid the penalty on November 3, 2022, and has therefore been deemed to admit the breach per Rule 4-59(5)(a).
