[1] I have reviewed correspondence from the Applicant dated January 9, 2008 and from Ms. Whittow dated January 17, 2008 concerning the stay of proceedings ordered by Anna Fung, QC on October 18, 2007.
[2] The Applicant has requested that Ms. Fung's order be varied. He requests that the three month suspension commence on February 7, 2008 through to and including May 7, 2008, instead of the time frame set out in Ms. Fung's reasons of October 18, 2008.
[3] The Law Society does not oppose the Applicant's request to commence his suspension at an earlier date. Further, the Law Society requested once again that the Applicant provide his undertaking that, pending the s. 47 Review, he will submit any written material intended for the courts to another counsel where the issues relate to the competence of other counsel.
[4] On January 23, 2008, the Applicant submitted his undertaking.
[5] Accordingly, I grant the application. The Applicant will be suspended from February 7, 2008 to May 7, 2008.
