Introduction to the annotated Professional Conduct Handbook

This annotated version of the Professional Conduct Handbook is designed to permit practitioners and the public to have access to selected decisions and opinions relevant to various rules set out in the Professional Conduct Handbook.  Although there has been minor editing of some opinions, no attempt to rationalize the decisions and opinions has been made.

The Law Society intends to update the Annotated Professional Conduct Handbook on a regular basis and comments and suggestions for improvements to it are welcome and should be made to Jack Olsen at jolsen@lsbc.org.

Contents

This book contains the full text of the Professional Conduct Handbook with annotations selected from:

  • Law Society of British Columbia's Ethics Committee minutes (since 1990)
  • Law Society of British Columbia's discipline hearing digests (since 1995)
  • Relevant Canadian case law (since early 1990s)

All references are linked to the original material, whenever possible.

Currency

The annotations in this Handbook are current to the following dates:

  • Ethics Committee minutes (December 31, 2008)
  • Discipline digests and decisions (December 31, 2007)
  • Case law (December 31, 2007)

Citations

The following abbreviations are used throughout the book:

  • EC refers to Ethics Committee minutes. For example, the reference EC March 2005, item 6 refers to item 6 of the Ethics Committee hearing in March 2005.
  • DCD refers to discipline cases prior to September 1, 2003. For example, the reference DCD 01-27 refers to discipline case number 27 from the year 2001.
  • DD refers to discipline decisions prior to 2007. For example, the reference DD 04-05 refers to discipline case number five from the year 2004.
  • LSBC refers to discipline cases after September 1, 2003. For example, the reference 2003 LSBC 20 refers to discipline case number 20 from the year 2003.

Cases are linked to full text decisions, wherever possible. Neutral citations were provided, when available. If a neutral citation was not available, some other reference information was provided (e.g., unreported citation; QL citation, etc.).
