Proposed anti-money laundering regulations and model rule

The Law Society of BC, along with the Federation of Law Societies of Canada, is seeking comments on the federal government's proposed anti-money laundering regulations governing client identification and verification.

The proposed regulations, under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, are drafted to apply to the way lawyers (and others) identify clients, verify their identity and maintain client records.

The federation, as part of its ongoing discussions with the government on anti-money laundering initiatives, has provided the Department of Finance with its preliminary comments on the regulations.

Independent of the government's proposed regulations, the federation has prepared a model rule on client identification and verification that is under discussion among the provincial and territorial law societies.

The Law Society of BC is seeking comments from lawyers to assist it in preparing its response to both the proposed regulations and the model rule. All comments received will also be forwarded to the Federation of Law Societies of Canada to assist it in developing formal submissions on the proposed regulations and in finalizing the model rule.
