The Law Society of BC draws the following matters to the attention of BC lawyers:

  • The Land Title Office e-filing system, available April 1
  • The new Business Corporations Act, in effect March 29
  • An opening for the position of Claims Counsel in the Lawyers Insurance Fund, with a closing date of April 13
The Land Title Office e-filing system, available April 1

As of April 1, 2004 the Land Title Office will accept electronic filings from BC lawyers, notaries and land title agents of these key documents in land transfers: Form A (Freehold Transfer), Form B (Mortgage), Form C (Charge), Form C (Release), Declaration, Property Transfer Tax Electronic Payment Authorization and Property Transfer Tax Return.

The electronic filing of documents in the Land Title Office is optional, not mandatory.

A lawyer who wishes to make electronic filings in the Land Title Office will first need to ensure that his or her computer systems comply with Land Title Office requirements, which includes acquiring and installing Adobe Acrobat 6.0 Standard software. The lawyer will also need to register with and obtain a digital certificate from Juricert (www.juricert.com), a company owned by the Law Society. The Law Society is the certification authority for professionals for the purpose of e-filing under the Land Title Act.

New Business Corporations Act, in effect March 29

The new Business Corporations Act, 2002, and amending statutes, and the Business Corporations Regulation come into force on March 29, 2004. As of that date, the Corporate Registry will no longer accept paper forms for those filings that are available through the Registry’s new Internet filing service, Corporate Online.

Lawyers should be familiar with the new legislation, which introduces both substantive and procedural changes in the incorporation, organization and activities of all British Columbia companies and the registration and obligations of all extraprovincial companies.

Position opening: Claims Counsel, Lawyers Insurance Fund

The Lawyers Insurance Fund has an opening for the full-time position of Claims Counsel. The successful applicant will become part of an outstanding team of lawyers managing and defending lawyers’ professional liability claims in a professional and supportive environment. The closing date for applications for this position is April 13, 2004.
