Nature of conduct to be inquired into:

1. On or about May 6, 2013, in representing your client SA in the sale of real property located in Port Moody, British Columbia, you breached a trust condition imposed in a letter from KH dated April 24, 2013, received by your staff member, enclosing an executed Form 17 Cancellation of Charge, that the net proceeds of sale of the property be paid in trust to Jenkins Marzban Logan LLP, when your staff released the net proceeds to your client instead of the law firm, contrary to Rule 7.2-11 of the Code of Professional Conduct for British Columbia.

This conduct constitutes professional misconduct pursuant to s. 38(4) of the Legal Profession Act.

2. In the course of representing SA in the sale of real property located in Port Moody, British Columbia, you abdicated your professional responsibility by some or all of the following:

(a) failing to maintain responsibility for the conduct of the file;

(b) improperly delegating tasks to, or failing to adequately supervise, the conveyancer handling the transaction, contrary to Rules 6.1-1 or 6.1-3 of the Code of Professional Conduct for British Columbia.

This conduct constitutes professional misconduct pursuant to s. 38(4) of the Legal Profession Act.
