Nature of conduct to be inquired into:
1. In or around October 2011, in respect of cash funds of approximately $4,000 received in trust from your client CC, you failed to handle those funds in accordance with Division 7 of Part 3 of the Law Society Rules, and in particular, you failed to do one or more of the following:
(a) deposit the funds to a trust account, contrary to Rule 3-51;
(b) maintain a duplicate cash receipt for the amount of funds received, contrary to Rule 3-61.1;
(c) record each trust or general transaction related to these funds, promptly or at all, contrary to Rule 3-63;
(d) upon discovering a shortage, immediately eliminate the shortage, contrary to Rule 3-66(1); and
(e) upon discovering a shortage, immediately make a written report to the Executive Director, contrary to Rule 3-66(2).
This conduct constitutes professional misconduct or a breach of the Act or rules, pursuant to s. 38(4) of the Legal Profession Act.
