Statement of account rule change: BC Code

At their June meeting, the Benchers adopted an amendment to the Code of Professional Conduct for BC. The change adds the following as commentary [1] to rule 3.6-3 [Statement of account]: "A lawyer's duty of candour to a client requires the lawyer to disclose to the client at the outset, in a manner that is transparent and understandable to the client, the basis on which the client is to be billed for both professional time (lawyer, student and paralegal) and any other charges." 

The Notaries Society and the Law Society

As explained in President Ken Walker, QC's blog postings on April 14 and June 22, the Law Society is considering the possibility of merging the Notaries Society's regulatory operations with those of the Law Society. Consideration of merging regulatory operations was prompted by a letter from then Minister of Justice Shirley Bond. With just over 300 notaries public and more than 11,000 practising lawyers, merging the two regulatory organizations appeared worth considering. The two working groups established earlier this year to look at governance and qualifications issues have now met several times and expect to continue their work into the summer.

Reminder: Revised and consolidated Law Society Rules in effect July 1

In April, the Benchers adopted revised and consolidated Law Society Rules that will come into effect on July 1, 2015. The revisions re-number the rules, eliminate decimal numbering, update and add marginal notes to cross-references to aid recognition, and ensure consistency and economy of language, among other changes. A revised Notice to the Profession relating to the Chief Judge's Assignment of Duties to Judicial Case Managers (NP 03) was issued by Chief Judge Crabtree effective June 1, 2015 and is available for download: Revised NP 03 - JCM Assignment of Duties.
