Insurance program and policies

The Lawyers Insurance Fund manages the Law Society’s insurance program for BC lawyers. Through the BC Lawyers’ Compulsory Professional Liability Insurance Policy, the program provides the following insurance:

The program also offers optional business innocent insured cover (BIIC) for business-related claims that the Policy does not cover.  Both the Policy and the optional insurance are issued by the Law Society through its wholly-owned subsidiary, the LSBC Captive Insurance Company Ltd. Excess insurance is available in the private market.

The current policy is LPL 17-01-01. The terms and conditions of the Policy are revised from time to time. Consolidated policies are issued every few years, and renewal endorsements other years. Policies and endorsements issued since 1999.

Who participates and who is exempt

Every BC lawyer in private practice must participate in the insurance program and pay the annual insurance fee ($1,750 plus tax, 50 per cent discount for part-time practitioners), unless exempt. Exemptions for lawyers in private practice include research lawyers (see answers to "What is covered and what is not?" in My Insurance Policy: Q&A) and dual members.

Lawyers not in private practice – retired, non-practising or in-house counsel – do not generally pay the annual insurance fee, although if you are a trade union, society or public legal services lawyer, as you may choose to pay the insurance fee for some coverage.

Lawyers who are exempt and do not pay the insurance fee still enjoy some insurance. Under Part A, you are insured for certain pro bono services and for any claims that might arise out of your earlier private practice. You are also insured for theft under Part B.

Non-lawyer partners in a multidisciplinary practice (MDP) must also participate and pay the annual insurance fee.
