Referral fees

The following are resources that may be helpful in answering your enquiry. Please familiarize yourself with them before moving on.

In brief: If you refer a matter to another lawyer because of their expertise, and the referral was not made because of a conflict of interest, you may accept, and the other lawyer may pay, a referral fee with the client’s knowledge and consent, provided it does not increase the total amount paid by the client. Check out the links below for more context.

Key Resources

Code - Division of fees and referral fees: BC Code rule 3.6-5 and 3.6-6.1.

Code - Referral cannot be due to conflict: BC Code rule 3.4-1.
