Splitting fees

The following are resources that may be helpful in answering your enquiry. Please familiarize yourself with them before moving on.

In brief: If there is consent from the client, fees for a matter may be divided between lawyers who are not in the same firm, provided that the fees are divided in proportion to the work done and the responsibilities assumed. However, a lawyer must not split fees or give a financial or any other reward to a person who is not a lawyer. Check out the resources below for more context.

Key Resources

Code - Division of fees and referral fees: BC Code rule 3.6-5 and 3.6-6.1.

Code - Definition of consent: BC Code rule 1.1-1.

Code - Definition of disclosure: BC Code rule 1.1-1.
