Summary of Decision on Application for Stay

George Coutlee

Kamloops, BC

Called to the bar: January 10, 1978

Decision issued: November 16, 2018 (2018 LSBC 32)

Hearing panel: Shona Moore, QC (chair); Darlene Hammell; Michael Welsh, QC

Counsel: Jaia Rai for the Law Society, George Coutlee on his own behalf

BACKGROUND

A citation alleges that George Coutlee provided legal services in family law without disclosing that he was suspended from the practice of law in all fields except for criminal law and personal injury claims. The person who initially made the complaint to the Law Society subsequently provided the Law Society with a statement that the legal advice provided by Coutlee was within his permitted areas of practice. That statement was supported by a statement from the complainant’s former spouse, also refuting the basis for the citation. Coutlee argues that based on these statements, Law Society staff investigating the matter should have concluded that there was no basis for the allegations.

DECISION ON APPLICATION FOR STAY

The hearing panel concluded that whether the allegations in the citation are valid can only be determined once all the evidence has been heard. The panel dismissed the application.
