APPLICATION FOR DECLARATIONS

A hearing panel found that Gerhardus Albertus Pyper had committed professional misconduct and a breach of the Legal Profession Act (2016 LSBC 01).

The panel was scheduled to meet for the disciplinary action phase of the hearing, but instead considered two motions brought by Pyper, one seeking declarations that he was entitled to engage in the practice of law in two specific situations despite having ceased to be a member of the Law Society, and one seeking an adjournment of the hearing pending an appeal.

The panel granted the adjournment on specified conditions.

The panel found that the declarations Pyper sought have no relation to the amended citation and therefore beyond the authority of the panel. The application for declarations was dismissed.

Pyper has filed Notice of Appeal in the Court of Appeal in February 2016, appealing the findings on facts and determination.
