The Lawyers Indemnity Fund is seeking a lawyer for a 7-month contract role as Claims Counsel. Claims Counsel are responsible for the management and cost-effective resolution of claims and potential claims under three Law Society programs: professional liability indemnification for lawyers, trust protection coverage for the benefit of the public, and corporate liability insurance for LIF staff. Claims Counsel are also responsible for advance rulings on coverage, giving risk management advice, and preparing and delivering presentations and written material to lawyers and law firms.
The position requires that Claims Counsel act as counsel and efficiently manage an assigned case load involving various areas of law and claims for amounts up to and in excess of the indemnity limits of $1 million.
The responsibilities of this position include:
- Investigating professional negligence and theft claims against lawyers
- Determining the applicability of indemnity coverage
- Defending lawyers in some Provincial Court and Supreme Court actions
- Managing the defence of actions by outside counsel in appropriate circumstances
- Developing and implementing strategies to effectively resolve claims and negotiating settlements
- Participating in loss prevention activities and providing information and advice to covered lawyers on practice and risk issues
- Such other duties as the Directors of Claims or LIF’s Chief Operating Officer may require
Qualifications
- You must be a member in good standing of the Law Society of BC with a minimum of five years of recent litigation or solicitor practice experience in family law, estate administration, criminal law, and administrative law. An excellent reputation in the legal community is essential.
- Preference will be given to candidates who have experience defending professional liability claims, or working as in-house defense counsel for an insurer.
- You have excellent interpersonal and communication skills, strong analytical abilities, superior advocacy and sound judgment. You take a practical approach to issues.
- You also have superior writing skills and work effectively in stressful situations.
This position combines the challenges of private practice, a collegial workplace and a focus on excellence. As Claims Counsel, you will be part of a team of lawyers managing and defending professional liability claims against lawyers in a professional and supportive environment.
The terms and conditions of the Collective Agreement between the Law Society and the Professional Employees Association apply to this position. The salary range for this position is $145,326.22 to $176,101.67.
