The Law Society of BC is seeking a permanent, full-time, Staff Lawyer, Alternative Discipline Process in our Professional Regulation department. The Staff Lawyer, Alternative Discipline Process (“ADP”) is responsible for administering the Law Society’s Alternative Discipline Process which includes responsibility for program design and operations as well as the effective management and resolution of ADP files.
The duties of the position include:
ADP
- Gathering and assessing all necessary information to process ADP files;
- Liaising with Professional Conduct staff regarding the transfer of files between Professional Conduct and ADP;
- Providing subject lawyers with information about the ADP at the referral stage;
- Reviewing and analyzing complaints, reports and medical records relevant to ADP files;
- Retaining and instructing healthcare professionals;
- Communicating with key stakeholders in the ADP process including: the subject lawyer, complainants, healthcare professionals; & medical monitoring agencies;
- Drafting correspondence, interim agreements and consent agreements;
- Providing advice and information to the Chief Legal Officer and Executive Director to assist them in making decisions about ADP files or acting as the Executive Director’s delegate in making decisions about ADP files;
- Drafting decisions for approval by the Executive Director;
- Monitoring subject lawyers’ compliance with consent agreements;
- Gathering and collating data about the ADP to support program operations and evaluation;
- Maintaining the ADP section of the Law Society’s website;
- Developing and maintaining relationships with other professional bodies engaged in similar programming;
- Regularly participating in continuing professional development related to mental health and trauma informed practice;
Regulatory Policy
- Conducting legal research.
- Conducting legal analysis on proposed policy and amendments to Law Society Rules.
- Preparing legal memos.
- Gathering information and data from various sources including other regulatory bodies.
- Performing statistical analysis.
- Drafting guidelines and internal policies.
- Preparing reports to Benchers and other groups, including the Federation of Law Societies of Canada.
- Liaising with and responding to questions or inquiries from other departments, Law Societies, and the Federation of Law Societies of Canada regarding policies, processes and initiatives.
- Such other duties as the Chief Legal Officer may require.
Qualifications
- Practising membership in the Law Society of BC or eligibility for membership.
- A minimum of 5 years of recent practice experience in administrative law.
- Must have experience appearing before administrative tribunals. Experience drafting written submissions an asset.
- Must have experience dealing with medical professionals and medical information.
- Course work or training in trauma informed practice and mental health would be an asset.
- Superior writing and excellent interpersonal and communication skills.
- Ability to meet changing deadlines and work in highly stressful situations.
- Project management, policy development and legal experience are strong assets.
- Excellent organizational, communication and interpersonal skills are essential along with the ability to work independently and collaboratively within a team.
The salary range for this position is $145,326.22 to $176,101.67.
