Reporting Trust Shortages and Cash Transactions

Lawyers can submit trust shortage and cash reports quickly and easily through the Member Portal under Tools and Reporting.

The online reporting form helps lawyers capture all relevant information and generates a PDF copy of the completed report for their records.

Rule 3-74 requires a lawyer who discovers a trust shortage to immediately pay enough funds into the account to eliminate the shortage. In addition, the lawyer must immediately make a written report to the Law Society if the shortage is greater than $2,500, or if they cannot deliver up any trust funds when due.

Rule 3-59 requires a lawyer who receives aggregate cash for a client matter greater than $7,500, when not permitted to do so, to return the cash and make a written report to the Law Society within 7 days of receipt of the cash.
