New Westminster lawyer Michael Saul Menkes has admitted to professional misconduct and agreed to a six-week suspension, effective June 8, 2026. He has also given an undertaking to the Law Society to not practice in the area of real estate law.
In a consent agreement, Menkes admitted that in the course of representing the borrowers in a real estate matter, he failed to honour a trust condition imposed by the lender’s lawyer when he filed two mortgage discharges in relation to two properties prior to receiving the net proceeds of sale for the properties. He also admitted that he represented to the lender’s lawyer that the mortgage discharges filed by him had been withdrawn when he had not verified whether that was true, and failed to correct the representation when he later learned the mortgage discharges had been registered.
In accepting the agreement, the Chair of the Discipline Committee considered an Agreed Statement of Facts and a letter from Menkes which acknowledged his misconduct. The Chair also considered aggravating and mitigating factors.
